OVERVIEW

Welcome to Girls Will Get It.

The terms "we", "us", and "our" refer to the operator of Girls Will Get It (the "Store"). We operate this Store and website, including the information, content, features, tools, products, and services made available through it (collectively, the "Services").

Our Store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms") describe the rules, rights, and responsibilities that apply when you access, browse, interact with, or purchase through the Services.

Please read these Terms carefully. They contain important information concerning orders, payments, delivery, intellectual property, disclaimers, limitations of liability, and other legal matters.

We make reasonable efforts to describe and display our products accurately.

Product photographs, videos, illustrations, and other visual materials are intended to help represent the product being offered.

However, the appearance of colors, brightness, contrast, and other visual characteristics may vary depending on your screen, device, display settings, and lighting conditions.

Minor differences that result solely from display technology, photography, lighting, or reasonable manufacturing variation may occur.

Nothing in this section permits us to supply a product that is materially different from its description or removes any mandatory rights relating to defective, misdescribed, incorrect, unsafe, or otherwise non-conforming goods.

Product descriptions, specifications, availability, and product ranges may be updated from time to time.

We may discontinue a product or limit quantities where reasonably necessary, including for stock limitations, geographic restrictions, fraud prevention, legal compliance, or operational reasons.

Any changes made to a product listing after an order has been accepted will not retrospectively alter the material characteristics of the product that you purchased.


SECTION 3 - ORDERS AND ORDER ACCEPTANCE

When you submit an order, you are making an offer to purchase the products identified in that order.

Receipt of an automated order acknowledgement does not necessarily mean that your order has been finally accepted.

An order is accepted when we confirm acceptance, begin fulfillment, or otherwise communicate that the order has been accepted, subject to applicable law.

We may decline, place on hold, or cancel an order for legitimate reasons, including:

• suspected fraud or unauthorized payment;
• inaccurate or incomplete order information;
• inability to verify information reasonably required to process the order;
• pricing or listing errors;
• product unavailability;
• delivery restrictions;
• quantity or resale concerns;
• sanctions, export, customs, or other legal restrictions; or
• another reason reasonably necessary to protect the Store, customers, or comply with applicable law.

We will not exercise this right for an unlawful or discriminatory reason.

If we cancel an order after receiving payment and no amount is lawfully due from you, the applicable amount will be refunded.

Please review your order carefully before submitting it.

We may be unable to stop or modify an order once fulfillment or processing has begun.

Any cancellation, return, withdrawal, refund, replacement, repair, or other remedy remains subject to our Refund Policy and any mandatory rights available under applicable consumer law.

Products purchased through the Store are intended for personal or household use unless we expressly agree otherwise.

We may limit or refuse orders that reasonably appear to be placed for unauthorized commercial resale, fraudulent activity, or other prohibited purposes.


SECTION 4 - PRICES, DISCOUNTS, AND BILLING

Prices, promotions, and discounts may change from time to time.

Unless required otherwise by applicable law, a price change does not affect an order that has already been accepted.

The price applicable to your order will be displayed during checkout and reflected in your order confirmation or payment record.

Taxes, shipping costs, customs duties, import charges, or other fees may apply depending on the destination and applicable law.

Where required, such charges will be displayed, included in the price, or their possible existence will be disclosed in accordance with applicable law.

Customs duties, import taxes, or charges imposed directly by a government authority, customs authority, carrier, or another third party may be subject to that authority's or third party's procedures.

You agree to provide accurate and current billing and payment information.

You represent that you are authorized to use the payment method submitted for an order.

Payments may be processed by independent payment service providers.

A payment authorization, payment hold, or pending charge does not necessarily constitute final acceptance of an order.

Promotional offers may be subject to additional conditions stated at the time of the promotion.

Where promotion-specific conditions conflict with these Terms, the specific promotion conditions will apply to that promotion, except where mandatory law provides otherwise.


SECTION 5 - SHIPPING AND DELIVERY

Delivery dates and transit times displayed on the Store are estimates unless we expressly state that a particular delivery date is guaranteed.

We make reasonable efforts to process and deliver orders in accordance with the shipping information provided to customers.

Delivery may be affected by circumstances including carrier disruptions, customs processing, severe weather, natural disasters, transportation interruptions, government action, inaccurate customer information, or other circumstances outside our reasonable control.

Nothing in this section removes any mandatory delivery rights available to you under applicable law.

We remain responsible for delivery and risk of loss to the extent required by applicable law.

Where applicable law provides that risk remains with the seller until the customer, or a person designated by the customer other than the carrier, obtains physical possession of the goods, that rule will apply.

Where you independently arrange a carrier that was not offered or designated by us, risk may transfer at a different time where permitted by applicable law.

Please include your order number and any relevant delivery information.

We may reasonably request information necessary to investigate a missing-delivery claim with the carrier or fulfillment provider.

Providing such information does not remove any mandatory consumer rights.


SECTION 6 - INTELLECTUAL PROPERTY

The Services and their original content, including text, branding, page design, graphics, photographs, videos, audio, software, and other materials, are owned by us, our licensors, or other applicable rights holders, except where otherwise stated.

User-generated content, reviews, feedback, trademarks, and third-party materials may remain owned by their respective rights holders and may be used by us under applicable licenses, permissions, or legal rights.

The Services are made available for personal and lawful use.

Unless authorized by us or otherwise permitted by law, you may not reproduce, distribute, republish, commercially exploit, systematically extract, or create unauthorized derivative works from protected Store content.

Nothing in these Terms transfers ownership of our intellectual property or the intellectual property of Shopify, our licensors, or any third party to you.

The Girls Will Get It name, branding, designs, and other brand identifiers may be protected by trademark, copyright, unfair competition, or other applicable laws to the extent legal rights exist in those materials.

Shopify's names, logos, products, and other brand identifiers belong to Shopify or its applicable rights holders.

All third-party names and trademarks remain the property of their respective owners.


SECTION 7 - OPTIONAL AND THIRD-PARTY TOOLS

The Services may provide access to tools, features, applications, or functionality operated by third parties.

We may not control or continuously monitor all third-party tools.

Third-party tools may be governed by separate terms, privacy policies, or other conditions imposed by the relevant provider.

Your use of an optional third-party tool is subject to the applicable provider's terms and policies.

To the fullest extent permitted by law, we are not responsible for the independent acts, omissions, systems, or services of a third-party provider that we do not control.

Nothing in this section excludes liability that cannot legally be excluded.

We may introduce new features, tools, resources, or functionality to the Services.

Unless otherwise stated, such additions form part of the Services and are subject to these Terms.


SECTION 8 - THIRD-PARTY LINKS AND SERVICES

The Services may contain links to third-party websites, platforms, resources, or services.

A link does not necessarily mean that we control, operate, or endorse the third-party website or service.

Transactions entered into directly with an independent third party are generally governed by the agreement between you and that third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Girls Will Get It is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make in our Store are made directly with the operator of Girls Will Get It.

By using the Services, you acknowledge that Shopify is not the seller of products purchased directly from our Store and is not responsible for the performance of the sales contract between you and us.

To the fullest extent permitted by law, Shopify and its affiliates are released from claims, damages, and liabilities arising solely from sales and transactions conducted directly between you and us.

Nothing in this section excludes any liability that Shopify independently has to you under applicable law or under a separate agreement between you and Shopify.

Personal information collected through the Services is handled in accordance with our Privacy Policy, which is made available on the Store.

If you voluntarily submit reviews, photographs, videos, comments, suggestions, ideas, or other content to us or through the Services ("Feedback"), you grant us, to the extent you have the necessary rights, a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, publish, display, distribute, format, and adapt the Feedback for operating, improving, and promoting the Services.

This license continues for as long as reasonably necessary for the permitted uses and to the extent allowed by applicable law.

• you own the Feedback or have the rights necessary to submit it;

• any material relationship, payment, gift, discount, or incentive connected with a review has been disclosed where required by law; and
• you will not intentionally misrepresent your identity or the origin of the Feedback.

We may moderate or remove Feedback where we reasonably believe it is fraudulent, unlawful, abusive, defamatory, obscene, infringing, malicious, deceptive, or otherwise violates these Terms.

We are not required to publish every review or piece of Feedback submitted to us.

Where applicable law restricts our ability to edit, suppress, or use consumer reviews, we will comply with those mandatory requirements.

We do not require reviewers to submit only positive Feedback.


SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may occasionally contain typographical errors, technical errors, inaccurate information, or omissions.

These may concern product descriptions, availability, pricing, promotions, shipping costs, or estimated transit times.

We may correct an error or update inaccurate information.

If a material pricing or listing error affects an order that has not been accepted, we may refuse the order.

If a material error affects an order after payment has been received, we may contact you to explain the issue and, where legally permitted, offer the correct terms or cancel the affected order and refund the applicable amount.

Nothing in this section permits us to retrospectively change an accepted consumer contract where applicable law prohibits such a change.

Nothing in this section limits rights concerning misdescribed or non-conforming goods.

• interfere with the security or operation of the Services;
• collect personal information unlawfully;
• send spam, phishing messages, or unauthorized solicitations;

We may restrict, suspend, or terminate access where we reasonably believe these Terms have been materially violated or action is reasonably necessary to protect the Services, users, or legal rights.

An Agent must not access or interact with the Services in a manner intended to conceal automated activity, bypass technical restrictions, circumvent security systems, or materially disrupt the Services.

Where we provide documented rules or instructions concerning automated access, Agents must comply with those requirements.

No Agent may falsely represent itself as a human where doing so would be deceptive, unlawful, or intended to circumvent a security measure.

Nothing in this section prohibits automated activity that cannot lawfully be restricted under applicable law.

We may suspend or terminate access to the Services where reasonably necessary, including in connection with:

• suspected fraud;

• compliance with a legal obligation.

Termination of access does not eliminate payment obligations validly incurred before termination.

Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, Feedback, liability, indemnification, severability, and governing law.

Termination does not remove rights or remedies already accrued under applicable law.


SECTION 16 - DISCLAIMER OF WARRANTIES

The general informational content of the Services is provided for general informational and commercial purposes.

We do not guarantee that the website will always operate without interruption, delay, technical error, or temporary unavailability.

To the fullest extent permitted by law, the digital Services are provided on an "as available" basis.

HOWEVER, NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES A WARRANTY, GUARANTEE, CONDITION, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED, RESTRICTED, OR MODIFIED.

This includes mandatory consumer rights that may apply to the quality, conformity, description, safety, durability, or fitness of goods.

Our Refund Policy and these Terms operate in addition to mandatory consumer guarantees and legal warranties where applicable.


SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL LOSS THAT WAS NOT REASONABLY FORESEEABLE AND THAT ARISES FROM YOUR USE OF THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE FOR LOSS CAUSED SOLELY BY:

• YOUR UNLAWFUL USE OF THE SERVICES;
• YOUR MATERIAL BREACH OF THESE TERMS;
• INACCURATE INFORMATION PROVIDED BY YOU;
• UNAUTHORIZED USE OF A PAYMENT METHOD BY YOU; OR
• AN INDEPENDENT THIRD PARTY WHOSE CONDUCT WE DO NOT CONTROL, EXCEPT WHERE APPLICABLE LAW IMPOSES RESPONSIBILITY ON US.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY WHERE SUCH EXCLUSION OR LIMITATION IS PROHIBITED BY LAW.

IN PARTICULAR, NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE LIABILITY FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR DEATH OR PERSONAL INJURY TO THE EXTENT LIABILITY FOR SUCH MATTERS CANNOT LAWFULLY BE EXCLUDED.

NOTHING IN THIS SECTION LIMITS MANDATORY RIGHTS OR REMEDIES RELATING TO DEFECTIVE, UNSAFE, MISDESCRIBED, OR OTHERWISE NON-CONFORMING GOODS.

Where applicable law permits liability to be limited but not excluded, our liability will be limited only to the maximum extent permitted by that law.


SECTION 18 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify us against third-party claims, losses, or reasonable legal costs directly resulting from:

• your intentional or unlawful misuse of the Services;
• your material breach of these Terms;
• content submitted by you that knowingly infringes a third party's rights; or
• fraud or unlawful conduct committed by you through the Services.

This indemnification does not apply to the extent a claim or loss was caused by our own unlawful conduct, negligence where liability cannot be excluded, or another matter for which applicable law prevents us from transferring responsibility to you.

We will provide reasonable notice of an indemnified third-party claim where practicable.

You will reasonably cooperate in the defense of the claim.

We will not impose a settlement requiring you to admit independent wrongdoing or undertake a material non-monetary obligation without your reasonable consent.


SECTION 19 - SEVERABILITY

If a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced only to the maximum extent legally permitted.

Where appropriate, the unlawful or unenforceable portion will be severed.

The remaining provisions will continue in effect unless applicable law requires otherwise.


SECTION 20 - WAIVER AND ENTIRE AGREEMENT

Our failure to immediately exercise or enforce a right does not automatically constitute a waiver of that right.

These Terms, together with the policies and specific terms incorporated into them, form the agreement governing your use of the Services to the extent permitted by law.

Nothing in this section excludes representations, information, or contractual terms that applicable law treats as binding or prevents us from excluding.

If different Store policies appear to conflict, they should be interpreted together where reasonably possible.

Where a mandatory consumer law conflicts with these Terms, the mandatory legal requirement will prevail to the extent of the conflict.

The remaining provisions will continue to apply to the fullest extent permitted by law.
